This User Agreement ("Agreement") outlines the terms and conditions for participating in the raffle ("Raffle") in which the winner will have the opportunity to entertain their favorite pornstar in Las Vegas. By purchasing a raffle ticket, you ("Participant") agree to be bound by the following terms:
| 1.1 Eligibility: |
| To participate in the Raffle, you must be at least 18 years of age or older, a legal resident of the United States, and have the legal capacity to enter into contracts. The Raffle is void where prohibited by law. |
| 1.2 Purchase of Raffle Ticket: |
| By purchasing a $5 raffle ticket, you agree to the terms and conditions set forth in this Agreement. The purchase of a raffle ticket is non-refundable and grants you one (1) entry into the Raffle. |
| 1.3 Raffle Drawing: |
| The winner will be selected at random from the pool of ticket holders. The date and time of the drawing will be communicated to all participants in advance on pornstarraffle.com |
| 2.1 Prize Description: |
| The winner of the Raffle will be flown to Las Vegas, Nevada, with lodging provided for two (2) nights. The winner will have the opportunity to meet and entertain their favorite pornstar, subject to the terms outlined below. |
| 2.2 Travel and Lodging: |
| The prize includes round-trip airfare (economy class) to Las Vegas and a two-night stay at a hotel. |
| 2.3 Pornstar Consent: |
| The pornstar involved in the entertainment experience will have final consent regarding participation. This means that the pornstar has the right to decline or alter any part of the planned engagement, at their discretion. |
| 3.1 Testing Protocol Requirement: |
| Before any adult entertainment activities take place, the winner will be required to undergo adult industry testing as provided by Talent Testing Services in Las Vegas. This is a mandatory step to ensure safety and compliance with industry health standards. The testing is at no cost to the winner, and all associated expenses will be covered by the organizer. |
| 3.2 Testing Consent: |
| By entering the Raffle, the winner consents to undergoing the necessary testing, which may include but is not limited to tests for sexually transmitted infections (STIs) and other health related screenings as specified by Talent Testing Services. |
| 3.3 Failure to Pass Testing: |
| If the winner fails the required health screenings, the entertainment experience will be canceled, and no alternative prize will be offered. In such a case, the winner will have no further recourse or claims against the organizer or the pornstar. |
| 4.1 Background Check Consent: |
| The winner agrees to undergo a background check before the engagement takes place. This check will assess the winner's criminal history, including any offenses that might preclude the entertainment engagement from taking place. The background check will be conducted by a third-party service and may include checks for prior sexual offenses or other relevant criminal behavior. |
| 4.2 Disqualification: |
| If the background check reveals any disqualifying information, the winner will be disqualified from the Raffle, and an alternate winner will be chosen. Any such disqualification will result in the forfeiture of the prize, and the winner will have no recourse against the organizer. |
| 5.1 Assumption of Risk: |
| By purchasing a raffle ticket and accepting the prize, the winner acknowledges and accepts the risks inherent in engaging in an adult entertainment experience, including but not limited to physical, emotional, or psychological risks. |
| 5.2 Liability Waiver: |
| The winner agrees to release, indemnify, and hold harmless the organizer, Talent Testing Services, the pornstar, and any other associated parties from any and all liability, claims, or damages arising from participation in the Raffle, acceptance of the prize, or any related activities. |
| 5.3 Limitations of Liability: |
| The organizer is not responsible for any lost or damaged tickets, technical errors in the Raffle process, or any accidents, injuries, or issues arising during the winner's trip or entertainment experience. The prize is provided "as is," with no warranty or guarantee beyond the travel and lodging arrangements. |
| 6.1 Modification of Agreement: |
| The organizer reserves the right to modify or amend these terms and conditions at any time. Any changes will be communicated to participants in writing. |
| 6.2 Governing Law: |
| This Agreement will be governed by and construed in accordance with the laws of the state of Nevada, without regard to its conflicts of law provisions. |
| 6.3 Severability: |
| If any provision of this Agreement is found to be unlawful, void, or unenforceable, the remaining provisions will continue in full force and effect. |
| 6.4 Entire Agreement: |
| This Agreement constitutes the entire understanding between the parties regarding the subject matter hereof and supersedes all prior agreements, discussions, and understandings. |
By purchasing a raffle ticket, you acknowledge that you have read, understood, and agree to all terms and conditions set forth in this Agreement.
